Terms of service
Pibblet Terms of Service
1. About these terms
These Terms of Service apply when you visit Pibblet, use our website, or purchase products from us.
Throughout these terms, “Pibblet”, “we”, “us” and “our” refer to the business operating pibblet.co.uk.
Our online store is hosted by Shopify, which provides the ecommerce platform we use to offer our products to you. Purchases made through our store are made directly with Pibblet, not Shopify.
By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy.
Nothing in these Terms affects your statutory rights under UK consumer law.
2. Using our website
You may use our website only for lawful purposes.
You must not misuse the website, attempt to interfere with its operation or security, introduce malicious software, fraudulently place orders, or use the website in a way that infringes the rights of another person.
You are responsible for ensuring that any information you provide to us, including your delivery and contact information, is accurate and complete.
If you create a customer account, you are responsible for keeping your login details secure.
3. Our products
We take reasonable care to ensure product descriptions, specifications, photographs and prices are accurate.
Colours and appearance may vary slightly depending on your screen and, where applicable, minor manufacturing differences.
Any measurements shown are approximate unless stated otherwise.
Products are subject to availability and may be changed or discontinued.
Goods supplied to UK consumers must meet the legal requirements that they are as described, of satisfactory quality and fit for purpose. Nothing in these Terms limits those rights. GOV.UK
4. Orders
When you place an order, you are making an offer to purchase the products in your basket.
You will receive an order confirmation after placing your order. We reserve the right to refuse or cancel an order where reasonably necessary, for example where:
- the product is unavailable;
- payment cannot be authorised;
- we reasonably suspect fraud;
- there has been an obvious pricing or listing error; or
- we cannot deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the affected amount.
Your rights to cancel an order are explained in our Return and Refund Policy.
Nothing in this section limits your statutory right to cancel qualifying online purchases within the applicable cancellation period.
5. Prices and payment
Prices are displayed in GBP (£).
The total amount you must pay will be shown before you place your order.
Any applicable taxes and delivery charges will be displayed before checkout. Where we advertise free delivery, no separate standard delivery charge will be added.
You must provide valid and authorised payment information.
Payment processing may be provided by Shopify Payments or another payment provider available at checkout.
6. Shipping and delivery
Our current delivery options, estimated delivery times and any applicable charges are described in our Shipping Policy and shown during checkout where appropriate.
Delivery estimates are not guaranteed dates. Delays can occasionally occur because of circumstances outside our reasonable control.
However, we remain responsible for fulfilling your order and nothing in these Terms removes rights you have under UK consumer law where goods are late, lost or not delivered.
Unless you independently arrange a carrier that we did not offer, responsibility for the goods remains with us until the goods are delivered into the physical possession of you or another person you have identified to receive them. Legislation.gov.uk
7. Cancellations, returns and refunds
Our Return and Refund Policy explains how cancellations, faulty goods, damaged goods and refunds are handled.
For qualifying online purchases, UK consumers generally have a statutory right to cancel within 14 days after receiving the goods, without needing to give a reason. GOV.UK
Pibblet currently offers a no-return-required arrangement for cancellations covered by our Return and Refund Policy, meaning we may issue the appropriate refund without requiring the item to be physically sent back to us.
Faulty, damaged, incorrect or misdescribed products are dealt with separately under your statutory consumer rights.
We may ask for reasonable evidence such as photographs or video where a customer reports that an item is faulty, damaged or incorrect. Such requests do not remove or restrict your statutory rights.
8. Intellectual property
The Pibblet name, branding, website design, written content and other original material belonging to us may not be reproduced or used commercially without our permission.
Certain product images, videos, trademarks or other material displayed on the website may belong to or be licensed from our suppliers, Shopify or other third parties and remain the property of their respective owners.
You may use our website for ordinary personal shopping purposes.
9. Third-party services and links
Our website may use or link to services operated by third parties, including Shopify and payment, delivery or technical service providers.
Third-party websites and services may have their own terms and privacy policies.
We are not responsible for the content of unrelated third-party websites that you choose to visit through an external link.
10. Shopify
Our store is powered by Shopify.
Shopify provides the ecommerce technology used to operate the store, but products purchased from Pibblet are sold by Pibblet.
Shopify is not the seller of the Pibblet products you purchase through this store.
Information relating to Shopify's processing of personal data is explained further in our Privacy Policy.
11. Privacy
We handle personal information in accordance with our Privacy Policy.
Information may be shared with service providers where reasonably necessary to process payments, fulfil orders, deliver products, operate our store, prevent fraud and provide customer support.
12. Reviews and customer content
If you voluntarily submit a review, photograph or other content to Pibblet, you confirm that you have the right to submit that material.
You must not submit unlawful, misleading, abusive, infringing or fraudulent content.
Where you give us permission to publish submitted content, we may display it in connection with Pibblet and our products.
We reserve the right to remove content that breaches these requirements.
13. Errors and corrections
Occasionally our website may contain an obvious error relating to a product description, availability, price or other information.
We may correct genuine errors when discovered.
If an error affects an order you have already placed, we will contact you where appropriate and deal with the order fairly and in accordance with applicable consumer law.
14. Availability of the website
We cannot guarantee that our website will always be available without interruption.
We may temporarily suspend or change parts of the website for maintenance, security or technical reasons.
This does not affect rights relating to orders you have already placed.
15. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- your statutory rights relating to goods;
- faulty or misdescribed products; or
- any other liability which cannot legally be excluded.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Because our products are supplied to consumers for personal and household use, we are not responsible for business losses such as loss of profits, revenue or business opportunities arising from consumer purchases.
16. Changes to these terms
We may update these Terms from time to time, for example because of changes to our business, services or applicable law.
The Terms applying to an order will normally be those in effect when that order was placed.
Any updated Terms will be published on this page.
17. Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
18. Governing law
These Terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections and rights available to you under the laws applicable where you live.
Nothing in these Terms restricts any rights you may have to bring proceedings in a court available to you under applicable consumer law.
